14. Warranties and Disclaimers
14.1 Product Warranty
Compartco warrants that all products sold are free from defects in materials and workmanship under normal usage for a period specified by the manufacturer’s warranty, applicable from the date of purchase by the original purchaser only. This warranty is non-transferable.

This limited warranty covers only defects in materials and workmanship. It does not apply to product issues resulting from misuse, abuse, neglect, alteration, problems with electrical power, acts of nature, improper use or maintenance, or installation not in accordance with our recommended installation instructions.

EXCEPT FOR THE EXPRESS WARRANTIES STATED HEREIN, COMPARTCO DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. Compartco does not authorize any person or entity to create for it any other obligation or liability in connection with its products.
14.4 Warranty Claims
To initiate a warranty claim, the original purchaser must contact Compartco’s customer service with proof of purchase and a detailed description of the defect. Compartco reserves the right to inspect the defective product before processing the warranty claim. Compartco may, at its discretion, repair or replace the defective product, or offer a refund.
14.5 Limitation of Damages
Compartco shall not be liable for any incidental, consequential, indirect, or special damages arising from the use of any product sold, or arising out of any breach of this warranty. Further, the liability of Compartco under this warranty is limited to the purchase price of the defective product.
14.6 Changes to Warranty Terms
Compartco reserves the right to amend or update these warranty terms without prior notice. Changes will apply to purchases made subsequent to such amendments.
15. Limitations of Liability
Compartco shall not be liable for any special or consequential damages that result from the use of, or the inability to use, the materials on this site or the performance of the products, even if Compartco has been advised of the possibility of such damages. Applicable law may not allow the limitation of exclusion of liability or incidental or consequential damages, so the above limitation or exclusion may not apply to you. 24. Governing Law and Jurisdiction
These Terms of Use and your use of the site are governed by and construed in accordance with the laws of the United States and the State in which Compartco is registered in, not including its conflict of law principles. You agree to submit to the personal jurisdiction of the courts located within the same State where Compartco is based in for the resolution of all disputes arising from or related to these Terms of Use and/or your use of the site.

In the event of a dispute, you agree first to contact us directly and attempt to resolve the dispute with us informally. In the unlikely event that Compartco has not been able to resolve a dispute it has with you after attempting to do so informally, we each agree to resolve any claim, dispute, or controversy through binding arbitration by the American Arbitration Association under the rules of its consumer arbitration. Any arbitration under these terms will take place on an individual basis; class arbitrations and class actions are not permitted.

Compartco shall not be liable for any failure to perform its obligations hereunder where such failure results from any cause beyond Compartco’s reasonable control, including, without limitation, mechanical, electronic, or communications failure or degradation (including "line-noise" interference). Such failure shall be considered a force majeure event, and Compartco’s performance under these Terms of Use shall be excused for the duration of the event.
